ADEM Elections, AD55 Alert – Greg Diamond is not Eligible

Orange Juice Blog Managing Editor Greg Diamond is — somehow — a candidate for the coming ADEM elections for 2021.  Somehow because he applied and someone at the State Party didn’t know he was expelled as a delegate in 2019 in a unanimous decision by the CADEM E-Board.  More on that in a minute.

As ballots in the mail are arriving, Diamond is listed as a candidate for ADEM.  Don’t waste your vote.  Staff turnover at the State Party neglected to pick up on Diamond’s suspension.  The original complaint called for him to be expelled for four years – through 2023.  Those involved in filing the paperwork were not sent a final copy of the decision so the team at the state party is researching this to get the full story.  But per Bylaws, he’s not eligible to run.  The only question is length of time — two years or four.  But he shouldn’t event be on the ballot and by applying, the state party should ban him permanently.

Diamond knew he was expelled.  State Party bylaws are also clear.  What’s not clear is what did Greg know and when did he know it?  I believe he deliberately thought he could pull one over on the state party and voters.  He’s read the bylaws and cites the state party bylaws and DPOC bylaws (and Roberts Rules of Order) frequently.

But on the OJ blog Thursday, he’s listed himself as a tier 1 candidate for ADEMs.  Arrogance, ignorance, dishonesty.  Pick one, pick all.  He writes: “I was not going to endorse myself — but I am not satisfied with the male candidates running for the Executive Board (more on which below).  I’m joined in the top tier by an incumbent, Bill Rawlings — a bright, warm, decent guy who really impressed me as we worked together”

At the hearing the officers shall examine the statement of charges brought against the accused member. The accused member shall be afforded an opportunity to respond to the charges, to confront any witnesses against such members, and may be represented by counsel if desired. Such hearing shall be conducted in such fashion as to afford the accused member due process of law. After such hearing, a sanction shall be imposed where appropriate. Except for a violation of the 9 provision of Article II, Section 9(b) which prohibits publicly giving support to or avowing a preference for a candidate nominated by another party, the sanction shall be removal from membership. Where the member has been found to have violated the prohibition on publicly giving support to or avowing a preference for a candidate nominated by another party, the sanction shall be removal from membership and a bar from reappointment or reelection to membership in This Committee, as defined in Article II, Section 1(b), immediately following the term during which the sanction of removal was imposed. For example, if the violation occurred in October 2008 and the sanction was imposed in December 2008, the removed member would be barred from renewed membership until after the convening of the annual meeting of This Committee in 2011; however, if the violation occurred in January 2009 and the sanction was imposed after the seating of members at the annual regular meeting of This Committee in 2009, the member would be barred from renewed membership until after the convening of the annual regular meeting of This Committee in 2013. Any finding of a violation, and the imposition of an appropriate sanction for that violation, shall require a vote of not less than two-thirds of the officers present and voting.

Oddly enough, Region 17 director and DPOC Treasurer Florice Hoffman filed a code of conduct complaint against Diamond in May 2019:  Here’s the text of that letter:

COMPLAINT AGAINST GREG DIAMOND UNDER THE CONVENTION CODE OF CONDUCT
This is a formal complaint against Greg Diamond pursuant to the Convention Code of Conduct.
Statement of Case

On Friday May 31, 2019, I attended the Credentials Committee appeal of Greg Diamond’s removal from the Democratic Party of Orange County (“DPOC”). The appeal was heard at the second session of the Credentials Committee at approximately 11:00 pm in Room 302. I attended as an officer, Treasurer, of the DPOC along with Jeff LeTourneau, Northern Vice Chair and Allyson Vincent, DPOC executive committee representative 55 AD. Both Jeff LeTourneau and I spoke on the DPOC’s behalf against Mr. Diamond’s appeal of his removal. Diamond’s appeal was denied at the committee meeting and right after the decision, Greg Diamond rushed over to where I was sitting and put his face in my personal space and starting yelling that I was a liar in front of the committee and others still in the audience. I was fearful of a physical confrontation from Mr. Diamond and left the room with Allison Vincent with Diamond following me out the door continuing to yell at me.

Once outside the room, fearful of my safety I was escorted away from Mr. Diamond by Victor Valladares, DPOC West Vice Chair to room 306-307 for the United Cannabis Business Reception. I stayed for about 5 minutes and told Mr. Valladares that I was upset and decided to leave the convention center and go back to my hotel. Victor Valladares walked me back past Greg Diamond where he was screaming in an agitated state at Jeff LeTourneau and I left the convention center with Jenna Beck to take the shuttle bus back to the hotel.
When I relayed the events to another delegate the next day at approximately 4:45 pm, he shared with me the Convention Code of Conduct and I decided to file these charges against Mr. Diamond.

Mr. Diamond engaged in harassment and bullying of me at the convention and at the Credentials Committee meeting and he disrupted the proceedings. Mr. Diamond’s credential should be revoked for interfering with the Convention Proceedings including the business of the Credentials Committee and intimidating, harassing and bullying the representative of the DPOC for successfully arguing against his appeal in the committee hearing. No one should be subjected to Greg’s Diamond’s harassment and bullying, and he should be removed as a delegate.

    • The comment was out of line; he can comment…but it goes up when I say so. The banned writer knows what they wrote and if they suggested what they wrote was about you and not Greg, you’d agree with me. banned commenters here is still under 10; several on moderation.
